Gottstein sets the record straight with a series of filings aimed to reveal the systematic pre-judgment implied in Lilly's language. John McKay, Gottstein's lawyer opens up a new front in this exchange with the revelation that the secret Zyprexa documents have been declassified since last year, when their confidentiality was challenged, and Lilly missed their chance to explain why these documents should be secret.
8 February 2007 USPRA filing is denied, or rather deferred, as the declassification of the documents will be considered after these proceedings complete.
7 February 2007 - Mindfreedom, AHRP, and EFF file a joint brief opposing the injunction (findings (A-D, E-G, H)and exhibits. 19 January 2007 - To clarify the outcome of Wednesday's hearing, the court asked Lilly to explain the "good faith basis" for the sealing of each document (they are required by the Protective Order to have a good faith basis before making things confidential, so the judge is just asking them for that). He also invited anyone who thought these documents should not be confidential to use the process set out in the Protective Order to challenge confidentiality.

We are outraged at the ways our freedoms are being stifled and oppressed. Here we are conducting a lawful and balanced discussion around the Zyprexa scandal, and our speech is being intimidated and chilled by Eli Lilly, a $12 Billion/year multi-national corporation. They are attempting to prevent us from speaking, but we will not be silent! We will dutifully respect the wishes of the court, and cease to explicitly link to contested materials, but will continue to discuss and analyze this issue critically and thoroughly.
For the past few years, there has been some controversy about the drug Zyprexa (a.k.a. Olanzepine). What we all know is that Zyprexa is an "atypical" neuroleptic (also known as an "anti-psychotic"), approved to treat schizophrenia and acute mania. At about $2.50/pill, it is a big money maker for Eli Lilly, somewhere on the order of $4 Billion a year. Zyprexa is the the world’s third best-selling drug. By themselves these facts are not controversial.

However, it seems that some internal memos indicate that Eli Lilly knew that the drug raised the risk of diabetes in patients and didn't act appropriately. They may have even misreported clinical trial data about blood-sugar risks to doctors. There is currently a class action lawsuit underway to hold Lilly accountable. These memos indicate that Lilly initiated an internal marketing campaign to willfully downplay these deleterious effects.
There may be other risks that the company knew about but was hiding.
Incidentally, Lilly's second most profitable drugs treat diabetes. No one here is suggesting an overt conspiracy, but the market-driven forces which describe late-capitalism are insidious and pervasive, powerful enough that they can be confused for intentionality.
Furthermore, Lilly has been training sales reps to instruct general practitioners to prescribe Zyprexa, off label, to elderly patients exhibiting general symptoms of dementia. These drugs are dangerous enough in the hands of specialists - general practitioners should not be trained by salespeople to prescribe such potent and dangerous psychopharmaceuticals. Lilly called this marketing initiative Viva Zyprexa, from which we have taken our satirical name for this campaign - Zyprexa Kills.
Medicare has born the brunt of Lilly's business practices. And after the elderly, children are their next target.
